Terms of Trade - GT Rentals Ltd The following are the terms and conditions of sale which apply to the
sale and purchase of any goods or services through GT Rentals Ltd. By placing an order with us you agree to these terms and
conditions: In the event that the account holder does not meet with our Terms of Trading,
GT Rentals Ltd reserves the right to charge a one off 5% Credit Fee and 2% interest per month until the account is paid in full. Accounts with a balance more than 30 days overdue may be suspended without
further warning. A $10 Suspension fee will be automatically applied. Suspended accounts may not be altered or closed until full
payment is received. Overdue accounts may be sent to a debt collection agency without further
notice. Any expenses incurred in the recovery of debt, including but not limited to legal and debt collection costs, shall be
claimed on the customer. GT Rentals Ltd also reserve the right to lodge a Personal Properties Security
on your vehicle which will prohibit you from selling the vehicle of you choose to. The Customer consents GT Rentals Ltd obtaining credit reports and information
containing personal information (as well as information concerning commercial credit worthiness and activities) for the purpose of
assessment for a application for credit (whether commercial or personal) or for the purpose of the collection of payments that are
overdue. An Invoice will detail your account. Please notify us in writing immediately
of any discrepancies, (recourse limitation seven (7) days). Goods are supplied in good faith and on a firm sale basis. Goods are not supplied on a consignment
or “sale or return” basis. If GT Rentals Ltd fails to enforce any terms or to exercise its rights under these terms of trade at any
time, the above mentioned Companies have not waived those rights. If any provision of these terms of trade is held to be invalid or
unenforceable for any reason, the remaining provisions shall remain in force and effect and the parties shall adjust their
respective rights and obligations in accordance with the spirit and intent of the parties as shown by the terms of trade. Ownership and the risk of any loss or damage to goods shall pass to you
immediately upon our delivery of the goods to the carrier. We are not a common carrier and do not undertake the obligations or
liabilities of one. Any specified delivery dates are estimates only and we shall not be liable for failure to deliver on the
estimated date. This agreement is governed by the laws of Prices may be altered without notice We have sole discretion to determine the amount of credit we will extend to
you at any time. You agree to pay for the services in full without deduction or setoff and to
pay goods and services tax and any other government duties, levies or taxes in respect of the services. Use of information under the Privacy Act 1993 and Privacy Code 2004: The
Customer and any Guarantor agree that any information about them provided at any time to GT Rentals Ltd may be used by GT Rentals
Ltd for any purpose connected with its business including (but not limited to) direct marketing, debt collection and credit
reporting or assessment. GT Rentals Ltd are authorised to provide such information to any external agency or party for credit
information and assessment purposes and that agency or party is hereby authorised to use and continue to use such information as
part of their business(es) services. GT Rentals Ltd and the external agency or party may retain and/or use such information for as
long as they see fit. Terms and conditions are subject to change without notice. |
